General conditions of sale

1. Purpose

 

These General Terms and Conditions of Sale govern the nautical services offered by Fakarava Excursions, such as lagoon and sea excursions, snorkeling, and diving activities, as the shipowner.

 

2. Services Offered

 

The services are described in detail on the website, brochures, and quotes. Any order implies acceptance of these General Terms and Conditions.

 

3. Reservation

 

The reservation becomes firm after:

 

- Acceptance of the quote or commercial offer.

 

- Payment of a deposit of 30% of the total amount.

 

4. Rates and Payment

 

Prices are indicated in Pacific francs (XPF) inclusive of tax.

 

The balance is due no later than the day of the service in cash (XPF) or by credit card.

 

Accepted payment methods: cash, payment link, credit card.

 

5. Cancellation and Refund

 

- By the client:

 

- Cancellation > 3 days before: full refund of the deposit.

 

- Cancellation < 3 days: deposit retained.

 

- No-show: 100% of the amount due.

 

- By the service provider:

 

In the event of adverse weather conditions or force majeure, the service may be postponed or the deposit will be refunded in full.

 

6. Liability

 

The service provider is insured for professional liability.

 

The client must respect safety instructions and comply with the instructions of the supervisory staff.

 

Any willful damage to equipment or dangerous behavior may result in exclusion without refund.

 

7. Physical and Medical Conditions

 

The client certifies that they are fit to participate in the booked water sports.

 

Any specific medical condition must be reported prior to the service, as must any food allergies and/or intolerances.

 

8. Insurance

 

Customers are advised to take out personal insurance covering water sports activities in the event of damage to a third party.

 

9. Personal Data

 

The data collected is used solely for booking management and is not shared with third parties.

 

10. Disputes

 

In the event of a dispute, an amicable solution will be sought. Failing this, the competent court will be the one for the location of the activity, namely Tahiti.

 

11. Safety

 

Participant safety is a top priority.

 

The service provider undertakes to provide equipment that complies with current standards and to supervise the activities with qualified personnel.

 

Customers must:

 

- Strictly follow the safety instructions provided before and during the activity.

 

- Wear the provided safety equipment (life jackets, buoyancy aids, etc.).

 

- Not endanger themselves or other participants or staff.

 

The service provider reserves the right to exclude any person whose behavior endangers the safety of the group, without refund. In the event of adverse weather conditions or identified risks, the activity may be postponed or canceled to ensure everyone's safety.

 

12. Weather Conditions

 

The water activities offered are subject to weather conditions.

 

The service provider reserves the right to modify, postpone, or cancel a service if weather conditions do not guarantee the safety of participants (strong winds, swell, thunderstorms, etc.), or in the event of an orange alert from Météo France.

 

In this case:

 

- The client will be informed as soon as possible.

 

- A new date will be proposed depending on availability.

 

- If rescheduling is not possible, the client will be entitled to a full refund of the amounts paid, without further compensation.

 

The service provider cannot be held responsible for the consequences of a cancellation or postponement due to adverse weather.

 

13. Refunds

 

Refunds are issued in the following cases:

 

- Cancellation by the service provider for weather or technical reasons: full refund of amounts paid.

 

- Cancellation by the client within the specified timeframe (see clause 5): partial or full refund depending on the cancellation deadline.

 

- Unable to reschedule a service canceled by the service provider: full refund.

 

Refunds are issued using the same payment method used for booking, within 7 business days of confirmation.

 

No refunds will be issued in the event of:

 

- No-show by the client on the day of the service.

 

- Exclusion of the client for non-compliance with safety instructions or inappropriate behavior.
